1.1. These general terms and conditions of sale apply to purchases and orders made in the Lehepunkt OÜ (hereinafter “Sirvi”) online store at sirvi.eu.
1.2. These terms form part of the sales contract concluded between Sirvi and the customer. The laws of the Republic of Estonia also apply. Consumer customers retain all statutory rights that cannot be restricted by contract.
1.3. If the customer is a legal entity or purchases goods for business or professional purposes, the special rules applicable to consumers do not apply, unless expressly stated otherwise in these terms.
1.4. Sirvi may sell Estonian and international magazines, newspapers, single issues, subscriptions, books, school and office supplies, and other products displayed in the online store.
1.5. The Privacy Policy and Cookie Policy are separate documents. These terms contain only a brief reference to the processing of personal data.
2.1. “Customer” means a person who uses the online store or places an order.
2.2. “Consumer” means a natural person who purchases goods for purposes unrelated to their business or professional activities.
2.3. “Product” means goods offered in the online store, including a single issue, book, school supply, or office supply.
2.4. “Subscription” means a fixed-term or open-ended contract under which issues of a magazine, newspaper, or other periodical publication are sent to the customer during an agreed period.
2.5. “Recurring payment subscription” means an open-ended or automatically renewing subscription paid for through recurring e-invoices, standing payments, or another recurring payment solution shown in the online store.
2.6. “Single issue” means one separately sold issue of a newspaper, magazine, or other periodical publication.
2.7. “Delivery partner” means a postal operator, parcel locker service provider, courier, or another party used by Sirvi to deliver an order.
3.1. Sirvi provides the main characteristics, price, and any available delivery information for products in the online store. Product images are illustrative, but Sirvi aims to ensure that the description corresponds to the actual product.
3.2. The cover image, publication date, number of pages, supplements, or other design elements of a publication may change at the publisher’s discretion. Such a change is not considered a defect if the product corresponds in content to the publication ordered.
3.3. Product availability may change. If an ordered product cannot be delivered, Sirvi will notify the customer as soon as possible and offer the option to choose a replacement product, a new delivery time, or cancellation of the order. If the order is cancelled, the amount paid will be refunded.
3.4. Sirvi may refuse to fulfil an order if the price or other material information displayed in the online store was incorrect due to an obvious technical error and the customer could reasonably have been expected to recognise the error. In such a case, Sirvi will contact the customer and refund the amount paid.
4.1. All prices displayed in the online store are in euros and include VAT unless otherwise stated for the product.
4.2. Delivery fees and any other additional charges are shown to the customer before the order is confirmed. The customer is not required to pay any fee that was not clearly disclosed before the contract was concluded.
4.3. The price of a subscription may depend on the subscription period, publication frequency, destination country, and delivery method.
4.4. If the price of an open-ended or automatically renewing subscription changes, Sirvi will notify the customer on a durable medium within a reasonable period before the new price takes effect. The notice will explain the new price, when it takes effect, and the customer’s right to cancel the subscription before the price change.
4.5. When displaying a discounted price, Sirvi complies with statutory price information requirements.
5.1. To place an order, the customer selects a product or subscription period, adds it to the shopping cart, enters the required information, chooses the delivery and payment methods, and reviews the order.
5.2. Before placing the order, the customer can correct any input errors. The customer is responsible for ensuring that the name, address, phone number, email address, and other information provided are correct.
5.3. Before confirming the order, the customer must be able to review the terms and conditions and confirm acceptance of them. The order confirmation button must clearly indicate that placing the order entails an obligation to pay.
5.4. After the order is placed, Sirvi will send an order confirmation to the customer’s email address together with the main contract details and the terms and conditions, or a link from which the terms and conditions can be saved.
5.5. If the customer does not receive an order confirmation, they should check their spam folder and contact Sirvi if necessary.
6.1. The sales contract enters into force when Sirvi has confirmed the order and payment has been received, or when the payment obligation has been duly confirmed according to the selected payment method.
6.2. For payment by invoice or e-invoice, the contract enters into force when the order is confirmed, unless Sirvi has stated otherwise for the order.
6.3. Sirvi has the right to reject an order before the contract enters into force, for example if the product is unavailable, the customer’s details are clearly incorrect, or there is a justified risk of fraud or non-payment. Sirvi will notify the customer and refund any payment received.
7.1. Orders can be paid for using the payment methods displayed in the online store.
7.2. Payment may be processed through Sirvi’s payment service partner. In such a case, the customer provides the information required to make the payment to the relevant service provider.
7.3. When paying by e-invoice, the invoice is sent to the bank or other agreed channel selected by the customer. Receiving an e-invoice does not mean that the invoice is paid automatically, unless the customer has entered into an e-invoice standing payment agreement with their bank.
7.4. If payment is not received by the due date, Sirvi may suspend fulfilment of the order or cancel the order after notifying the customer.
7.5. Sirvi issues invoices to customers electronically unless otherwise agreed.
8.1. Orders are delivered using the method selected in the online store and to the area indicated when placing the order.
8.2. Available delivery methods, prices, and estimated delivery times are displayed before the order is confirmed.
8.3. If no specific delivery time has been agreed, Sirvi will fulfil the order without undue delay, but generally no later than 30 days after the contract is concluded. For subscriptions, the subscription start date and the publication schedule are taken into account.
8.4. The risk of accidental loss of or damage to the goods passes to the consumer when the consumer or a third party designated by the consumer, other than the carrier, has taken possession of the goods.
8.5. The customer must provide a complete and correct delivery address. The cost of resending an order due to an incorrect address may be borne by the customer if Sirvi informed the customer of this cost before resending the order.
8.6. If delivery is delayed for reasons beyond Sirvi’s control, Sirvi will notify the customer as soon as possible and provide an opportunity to agree on a new reasonable deadline. If delivery is not made within the additional period, the consumer may terminate the contract and receive a refund of the amount paid.
9.1. A subscription begins with the issue, month, or date indicated for the order. If the exact start cannot be determined immediately, Sirvi will notify the customer in the order confirmation or a separate notice.
9.2. Publication frequency and publication dates are determined by the publisher. Publication frequency may change, and a single issue may be published as a double issue. Such a change does not necessarily extend the calendar duration of the subscription if the publisher calculates the subscription based on the number of issues.
9.3. If the subscription is placed for a specific number of issues, it ends after the agreed number of issues has been sent. If the subscription is placed for a specified period, it ends on the agreed date, subject to the terms described for the product.
9.4. Sirvi is not responsible for a publisher’s decision not to publish an issue, to change the publication’s name or frequency, or to discontinue publication. In such a case, Sirvi will, where possible, offer a replacement, extend the subscription, or refund the unused portion.
9.5. If a publication has not reached the customer, the customer must notify Sirvi within a reasonable period so that Sirvi can investigate the matter and, where possible, send a replacement issue.
9.6. Delivery of international publications may be delayed due to international logistics, customs, the publisher, or the distributor. In such cases, the delivery time shown in the online store or order confirmation is an estimate unless a specific date has been expressly guaranteed.
9.7. The delivery of a replacement issue for an international publication depends on availability. If a replacement issue cannot be obtained, Sirvi will offer a reasonable alternative or refund the value of the missing issue.
10.1. Before the contract is concluded, the customer is shown at least the payment frequency, billing period, minimum subscription period, and cancellation procedure.
10.2. The customer can cancel a recurring payment subscription at least as easily as it was set up, for example through the customer account, by phone, or by written notice to Sirvi customer service.
10.3. The subscription ends after the notice period communicated to the customer has expired. The notice period must be reasonable and clearly stated on the product page.
11.1. An order for a single issue concerns a specific issue of a newspaper, magazine, or other periodical publication.
11.2. Availability of single issues may be limited. If the ordered issue cannot be delivered, Sirvi will notify the customer and refund the amount paid for it or, with the customer’s consent, offer a replacement.
11.3. Under the law, consumers do not have a 14-day right of withdrawal for newspapers, magazines, or other periodical publications sold as individual issues. This exception does not apply to subscriptions.
12.1. To change an order, the customer must contact Sirvi as soon as possible.
12.2. Sirvi will change the order if it is technically possible to do so before the order is prepared, dispatched, or the order details for the next publication are forwarded.
12.3. A change of address for a subscription takes effect after confirmation by Sirvi. An issue that has already been submitted for mailing may not be possible to redirect to the new address.
12.4. Changes to an order may affect the price or delivery time. Sirvi will notify the customer before confirming the change.
13.1. A fixed-term subscription ends on the agreed date or after the agreed number of issues has been sent.
13.2. The customer may cancel an open-ended subscription by notifying Sirvi by phone or in writing.
13.3. Cancellation does not affect payment obligations that arose before the cancellation took effect.
13.4. If the customer wishes to cancel a fixed-term subscription before the end of the agreed period for a reason other than a statutory right of withdrawal or a breach of contract by Sirvi, any refund for the unused period will be determined according to the terms published for the product and the agreement between the parties.
13.5. Sirvi may terminate a subscription exceptionally for good cause, for example due to repeated late payments, submission of false information, or misuse of the service. Where possible, the customer will first be given a reasonable period to remedy the breach.
14.1. A consumer has the right to withdraw from a distance contract without giving a reason within 14 days, unless an exception is provided by law.
14.2. The 14-day right of withdrawal does not apply to periodical publications, except in the case of a subscription contract.
14.3. When purchasing goods, the withdrawal period begins on the day when the consumer or a third party designated by the consumer, other than the carrier, takes possession of the goods.
14.4. If goods from one order are delivered separately, the withdrawal period begins when the last item is received. If the goods are delivered in several parts, the period begins when the final part is received.
14.5. In the case of a subscription involving recurring deliveries of goods, the 14-day period begins when the first publication sent under the subscription is received.
14.6. The consumer has the right to withdraw from the contract within 14 days. The withdrawal notice may be submitted in a form that can be reproduced in writing or via the withdrawal button on the Sirvi website. Use of the withdrawal button is not mandatory.
14.7. The consumer must return the goods to Sirvi no later than 14 days after submitting the notice of withdrawal.
14.8. The direct costs of returning the goods are borne by the consumer unless Sirvi has agreed to bear them or failed to inform the consumer of this obligation before the contract was concluded.
14.9. The consumer may handle and test the goods only to the extent necessary to establish their nature, characteristics, and functioning, as they would in a physical store. If the value of the goods decreases due to excessive use, Sirvi may claim compensation for the reduction in value.
14.10. Sirvi will refund all payments received from the consumer, including the cost of the standard least expensive delivery method offered, no later than 14 days after receiving the notice of withdrawal. If the consumer chose a more expensive delivery method, Sirvi is not required to refund the difference between the more expensive and standard delivery methods.
14.11. Sirvi may withhold the refund until the goods have been returned or the consumer has provided proof that the goods have been sent back, whichever occurs first.
14.12. Refunds are generally made using the same payment method used by the consumer, unless the parties agree otherwise and the consumer does not incur any fees as a result.
14.13. Returned goods must be sent to the agreed address.
15.1. Sirvi is liable for any lack of conformity of goods sold to a consumer that becomes apparent within two years of delivery.
15.2. If a defect becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery unless such a presumption is incompatible with the nature of the goods or the defect.
15.3. The consumer must notify Sirvi of the defect no later than two months after becoming aware of it.
15.4. Complaints must be sent to tellimine@lehepunkt.ee or submitted through another contact channel published by Sirvi. The complaint should include the customer’s name and contact details, the order or invoice number, a description of the defect, and the desired solution. Photos or other evidence should be included where possible.
15.5. Sirvi will respond to a consumer’s written complaint within 15 days. If more time is needed, Sirvi will explain the reason for the delay and provide a new reasonable response deadline.
15.6. In the case of defective goods, the consumer is primarily entitled to request repair or replacement if this is possible and proportionate. If repair or replacement is impossible, unsuccessful, or causes significant inconvenience to the consumer, the consumer may be entitled to a price reduction or to withdraw from the contract.
15.7. If a periodical is not received or arrives damaged, an appropriate solution may be to send a replacement issue, extend the subscription, reduce the price, or refund the value of the missing issue, depending on the circumstances and availability of the publication.
15.8. The right to submit a complaint does not apply to defects that arise after delivery as a result of the customer’s actions, improper use, normal wear and tear, or another reason beyond Sirvi’s control.
16.1. Sirvi and the customer are liable for breaches of their obligations to the extent provided by law and these terms.
16.2. Sirvi is not liable for delays or breaches of obligations to the extent that they are caused by force majeure or another circumstance beyond Sirvi’s control that could not reasonably have been foreseen or avoided.
16.3. In the event of force majeure, Sirvi will notify the customer as soon as possible and make reasonable efforts to minimise its impact.
16.4. Limitations of Sirvi’s liability do not apply where damage was caused intentionally or through gross negligence, or where limiting liability would be contrary to law.
16.5. The consumer’s statutory rights are not restricted by this section.
17.1. Sirvi processes customers’ personal data for the fulfilment of orders, customer service, payment processing, compliance with legal obligations, and on other grounds described in the Privacy Policy.
17.2. The purposes and legal bases of personal data processing, retention periods, recipients, and customer rights are described in Sirvi’s separate Privacy Policy.
17.3. The use of cookies and similar technologies is described in a separate Cookie Policy.
18.1. If the customer has a question or complaint concerning an order or product, they are asked to first contact Sirvi customer service by email at tellimine@lehepunkt.ee or by phone at +372 633 6117.
18.2. Sirvi and the customer will attempt to resolve the dispute through negotiations.
18.3. If the consumer and Sirvi are unable to reach an agreement, the consumer may contact the Consumer Disputes Committee operating under the Estonian Consumer Protection and Technical Regulatory Authority. Submitting an application to the committee is free of charge for the consumer. Before contacting the committee, the consumer must have submitted a complaint to Sirvi.
18.4. The consumer also has the right to take the matter to court. Estonian law applies to the dispute, but this does not deprive a consumer residing in another European Union country of the protection afforded by the mandatory consumer protection rules of their country of residence.
18.5. A dispute involving a legal entity will be resolved through negotiations or in an Estonian court in accordance with the law.
19.1. Sirvi has the right to amend these terms if required by changes in law, development of the online store or service, changes to payment or delivery methods, or another justified reason.
19.2. A one-time purchase is subject to the terms in force at the time the order is placed.
19.3. Sirvi will notify the customer on a durable medium within a reasonable period in advance of any material change to the terms of an open-ended or automatically renewing contract. If the change puts the customer in a less favourable position, the customer will have the right to terminate the contract before the change takes effect, unless the change results directly from a mandatory legal provision.
19.4. The current version is published on sirvi.eu together with its effective date.
